Jeremiah Acciarri, the undersigned, City Council, pursuant to Title VI of the effects of art. 46, 49 et seq. of Regulation shall submit the following query asking for an urgent report on the SV City Council. From investigations carried out at the Chamber of Commerce show that companies Offida Energy Ltd Offida and Gas Ltd., wholly owned by the City of Offida have formed, each for 12%, the Polo Piceno Energy Ltd., with registered offices in Viale De Gasperi 13 Offida, with the consequent participation of the City of Offida to 24%. Piceno, in turn, participates to the extent of 33% in Interpol Energia SpA (joint venture corporation), together with the Municipality of Offida to 8%, the Intermediate Holding (holding company known Consort) for the and 33% for another Eltec 33%, the latter of the foreign state of S. Marino, with legal representative that Fiorenzo Rivelli, managing director of IBS of San Marino. After the formation of Interpoloenergia spa, Eltec has acquired a stake in the energy hub Piceno where they already are members Offida Energy and Offidagas resulting in direct participation of the City of Offida. Energia SpA, as the energy hub Piceno, have their registered office in Viale De Gasperi 13 Offida along with Offida Energy Ltd and Gas Ltd. Offida. Neither the energy hub Piceno nor Interpol Energia SpA are having their registered office in the user telephone.

Abstract:

- That the government is a complex organization dedicated to the cure of the public;

- that the business activities of the company Offida Energy and Gas Offida are targeted to meet the collective needs and / or essential to the functioning of public administration, however, Eligible public services in the strict sense, since, although being mediated, are still available to the public interest;

- noted that, as reported by the Auditor in the Annual Report, art. 13, L. August 4, 2006, No 248, cd, the Bersani decree that certain rules that define the system's capacity for action of the companies whose capital is wholly publicly owned by local governments;

- that the rules limiting the following objectives: reduce costs of public agencies of reference, preserve competition, without alteration or distortion of the same and the market, thereby ensuring the equality of operators;

- that the said Article. 13 states are subject to the limitations in society;

- that in fact the Bersani Decree requires that companies: a) must operate only with entities contracting or participating constituents or b) can not carry benefits for other public or private or in foster care with no direct competition, c) can not participate in other companies or institutions, d) are at corporate purpose;


what circumstances having regard to the participation of energy companies Offida Offida Ltd and Gas Ltd., a wholly-owned single-member public with the City of Offida, the energy hub and Piceno the interpolation Energia SpA;

view that such participation seems to want to evade the obligation to operate exclusively for its shareholders, in violation of the ban expressed by law ("can not participate in society");

that such participation, made until April 2010, seems to evade the obligation set out in paragraph 3 of art. 13, Bersani Decree, that gives the company a time-limit of 12 months to stop the activities that are not allowed;

that given the situation and participation in society, the only alternative would be the sale of its holdings to the detriment of the local ;

also that participation in society Interpol Energia SpA, involves the participation of the City of Offida, albeit in a share of 8%, directly with companies that they are still part of the Italian list of countries to tax havens;

that the Republic of San Marino is in the order of the Minister of Economy as the country with no effective exchange of information with other states and total lack of transparency (this is also related to the lack of cooperation in the fight against money laundering - the OECD blacklist)

that such participation is not only useful to the local community, but above is not justified or justifiable by a government, just in relation to the requirement of transparency and international cooperation.

those circumstances and exposed

calls for the SV to immediately and urgently on the choice of the partnership Offida Energy Company Ltd. and the interpolation Offida Gas Energy spa;

- the public purpose of such participation;

- on the economic benefit derived by the City of Offida in this participation;

- if deemed appropriate and ethically correct, the participation of the City of Offida with companies from countries that do not ensure transparency and cooperation;

- if it intends to maintain those partnerships;

- if, in relation to partnerships referred to above and to the budgets of those companies, not for the City Council to decide on;

- which and how many resolutions which sanctioned the 'input of the City of Offida in society;

- if you were given the manner prescribed, also on institutional website and if you have ever acted on the company's operations Asteria in which it holds a participation;

- if, ultimately, the City of Offida monitor the operations and management of all the companies in which it participates and how;

- whether between members of the Joint Energy Piceno are farmers, companies or consortia of farmers owners of land falling in areas suitable for the production of photovoltaic systems, municipal regulation as approved by Resolution No. 16 of the 23 / 4 / 2009;

- if it is consistent participation in the City of Offida Interpoloenergia spa, a company engaged in various business sectors, and whose chief executive is assigned high financial powers (paragraph 13): "Making investments and disposals of financial instruments (...)".
